By accessing or using FreshTrack (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current information when creating an account. Notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload malicious code, viruses, or any harmful content.

4. Intellectual Property

The Service, including its design, features, and content, is owned by FreshTrack and protected by intellectual property laws. You retain ownership of the data you enter into the Service. We do not claim ownership of your inventory or business data.

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The free tier is provided on a best-effort basis without uptime commitments. Paid plans with SLA guarantees are available under separate agreements.

6. Limitation of Liability

To the maximum extent permitted by law, FreshTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

7. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance.
